This document explains the ways in which "Călinescu și Asociații" collects, processes and stores the personal data of its members.
The protection of personal data is very important to "Călinescu și Asociații" and we want you to be properly informed about the way and purposes in which "Călinescu și Asociații" processes your personal data.
If you notice any errors in the provision of personal data concerning you, please inform us as soon as possible, using any of the means indicated below.
- Principles of personal data processing
1.1. Personal data is processed by "Călinescu și Asociații" in good faith and in accordance with the legal provisions in force.
1.2. Personal data is collected by "Călinescu și Asociații" for well-determined, explicit and legitimate purposes, and further processing will not be incompatible with these purposes.
1.3. Personal data are adequate, relevant and not excessive in relation to the purpose for which they are collected and subsequently processed.
1.4. Personal data is not stored by "Călinescu și Asociații" for a longer period than is necessary to achieve the purposes for which they were collected.
1.5. "Călinescu și Asociații" has taken appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction, loss, alteration, disclosure, unauthorized access or any other form of unlawful processing, as well as regarding the deletion or rectification of inaccurate or incomplete data in terms of the purpose for which they are collected and for which they will be subsequently processed.
- Data categories and purpose of using personal data
2.1. The personal data referred to include identification elements such as name and surname, name and surname of the authorized persons (as applicable), professional data, judicial data, telephone number, e-mail address, which serve to identify you or the persons who represent you or whom you represent.
2.2. "Călinescu și Asociații" will collect, use, process and provide the personal data provided by you for the following purposes: registration for courses organized by "Călinescu și Asociații", issuing and transmitting documents and any other processes arising from membership or for non-members requesting documents issued by "Călinescu și Asociații" in order to register with the association.
2.3. Personal data is intended for exclusive use by "Călinescu și Asociații" and will not be sold to third parties.
2.4. "Călinescu and Associates" does not collect and process personal data belonging to minors.
- Security measures for processed personal data
3.1. This information note establishes technical and organizational measures implemented by "Călinescu și Asociații" to fulfill the obligations regarding the confidentiality and security of the processing carried out within the framework of its activity.
3.2. "Călinescu și Asociații" has adopted physical, electronic and managerial security measures to protect and secure the information we collect and process against accidental or unlawful destruction, loss, modification, disclosure, unauthorized access or any other form of unlawful processing. In this regard, a person responsible for compliance with the provisions of Regulation 679/2016 will be designated at the "Călinescu și Asociații" level.
3.3. Please note that unfortunately no data transmission is 100% guaranteed.
3.4. You are responsible for the documents submitted by "Călinescu și Asociații".
3.5. If you suspect that the confidentiality of your data has been violated, please contact us at the e-mail address office@scpa-ca.ro.
3.6. In order to comply with the related legal provisions and in order to meet the requirements for the safe storage of data and information, "Călinescu și Asociații" has developed and implemented organizational and technical measures focused on certain directions of action:
– User identification and authentication;
– Access type;
– Data collection;
– Execution of safety copies;
– Staff training;
– Telecommunications systems;
– Using computers;
– Printing data.
- Specific procedures
4.1. Identification and authentication of the user, by user being understood any person acting under the authority of the Association for Pediatric Orthopedics and Traumatology or the person authorized by "Călinescu și Asociații", with a recognized right of access to the personal database.
4.2. To gain access to personal data, users must register.
4.3. In the case of automated processing, identification is carried out by authentication in the computer systems of "Călinescu și Asociații", authentication being done by entering unique authentication data, consisting of user account and password.
- How long will we keep personal data?
5.1. Unless you object to the processing of your personal data by us and/or request the deletion of your personal data, the following retention periods apply, in accordance with our data retention policy, for the following categories of personal data:
– We do not store your personal data longer than is necessary for the purpose for which we retained it or to comply with a law or statutory requirement;
– For fiscal activities (invoice operations) we will retain the data for a period of 10 years.
- Your legal rights
6.1. As a data subject you have specific legal rights regarding the personal data we collect from you, "Călinescu și Asociații" respecting your individual rights and will take care of your interests accordingly.
– Right to withdraw consent: You can withdraw your consent to the processing of personal data at any time;
– Right to rectification: You can obtain from us the rectification of personal data concerning you. We make reasonable efforts to keep personal data – which is used continuously and which is in our possession or control – accurate, complete, current and relevant, based on the most recent information available to us;
– Right to restriction: You can obtain from us the restriction of the processing of personal data if you contest the accuracy of the personal data for the period in which we need to verify their accuracy, the processing is unlawful and you request the restriction of processing rather than the deletion of the personal data, we no longer need your personal data but you request them for the establishment, exercise or defence of a right or you object to the processing during the period in which we verify whether our legitimate reasons override yours.
– Right of access: You can ask us for information about the personal data we hold about you, including information about what categories of personal data we hold or control, what it is used for, where we collected it from, if not collected directly from you, and to whom it has been disclosed, if applicable. You can obtain from us a copy, free of charge, containing the personal data we hold about you. We reserve the right to charge a reasonable fee for each additional copy you may request.
– Right to portability: Upon request, we will transfer your personal data to another controller, where technically feasible, provided that the processing is based on your consent or is necessary for the performance of a contract. Rather than receiving a copy of your personal data, you can request that we transfer your data directly to another controller specified by you.
– Right to erasure: You can obtain from us the erasure of your personal data, if your personal data are no longer necessary for us in relation to the purposes for which they were collected or otherwise processed, you have the right to object to further processing of your personal data (see below) and to exercise this right to object to processing or the personal data have been processed unlawfully, unless the processing is necessary for compliance with a legal obligation that requires processing by us, in particular for legal requirements to retain personal data or for the establishment, exercise or defence of legal claims.
– Right to object: You may object at any time to the processing of your personal data due to your particular situation, provided that the processing is not based on your consent, but on our legitimate interests or those of a third party. In this case, we will no longer process the personal data, unless we can demonstrate compelling legitimate grounds and an overriding interest for the processing or for the establishment, exercise or defence of legal claims. If you object to the processing, please specify whether you wish to have your personal data erased or have our processing restricted.
– Right to lodge a complaint: In the event of an alleged breach of applicable privacy legislation, you may lodge a complaint with the supervisory authority for the protection of personal data in the country where you reside or where the alleged breach occurred.
Please note:
– Time period: We will try to fulfill the request within 30 days. However, the period may be extended for specific reasons related to the specific legal right or the complexity of the request.
– Access Restriction: In certain situations we may not be able to grant you access to all or part of your personal data due to legal requirements. If we deny your access request, we will inform you of the reason for the denial.
– Impossibility of identification: In some cases we may not be able to search for your personal data, due to the elements provided in your request.
– In such cases, where we cannot identify you as the data subject, we are unable to comply with your request to exercise the legal rights as described in this section, unless you provide additional information that allows you to be identified.
– Exercising your legal rights: To exercise your legal rights, please contact us at the email address office@scpa-ca.ro.
- Disclosure of your personal data to third parties
7.1. Your information may be shared with third-party institutions or companies that have supplier status to "Călinescu și Asociații".
7.2. Where necessary, we will engage other companies and individuals to perform certain tasks that contribute to our services on our behalf. We may, for example, provide personal data to couriers, agents, contractors or partners for hosting our databases, for data processing services or to send you information that you have requested. We will share or make that information available to external service providers to the extent necessary to process your requests.
- Public organisations
8.1. We will only disclose your personal data to public bodies if required to do so by law. For example, “Călinescu și Asociații” will respond to requests from courts, law enforcement bodies, regulatory agencies and other public and official authorities, which may include such authorities outside your country of residence.
